1. Agreement to Terms

By downloading, installing, or using the Papercup application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App is operated by Papercup Ltd ("we", "us", "our"), a company registered in New Zealand.

2. Description of Service

Papercup is a mobile phone application that enables children to make and receive phone calls to parent-approved contacts. The service includes:

  • A dedicated phone number for your child
  • Voice calling to approved contacts only
  • Call history visible to parents
  • Parental controls and contact management

3. Eligibility

To create an account, you must:

  • Be at least 18 years old
  • Be a parent or legal guardian of any child using the App
  • Provide accurate and complete registration information
  • Have legal authority to agree to these Terms on behalf of your child

4. Account Registration

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring information provided is accurate and current
  • Notifying us immediately of any unauthorised access

5. Subscriptions and Payments

Free Plan

  • Limited calling minutes per month
  • Access to core features
  • Subject to fair use policy

Paid Subscription

  • Additional calling minutes as specified in your plan
  • Billed monthly or annually as selected
  • Automatic renewal unless cancelled
  • Managed through the Apple App Store

Billing

  • Payments are processed through the Apple App Store
  • Prices are in New Zealand Dollars unless otherwise stated
  • You agree to pay all applicable fees and taxes

Cancellation

  • You may cancel your subscription at any time through the App Store
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial billing periods

6. Acceptable Use

You agree NOT to use the App to:

  • Make calls to emergency services as a primary means of contact
  • Harass, abuse, or harm another person
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the service
  • Attempt to gain unauthorised access to our systems
  • Use the service for any commercial purpose without permission

7. Parental Responsibilities

As a parent or guardian, you are responsible for:

  • Supervising your child's use of the App
  • Managing the list of approved contacts
  • Reviewing call history regularly
  • Ensuring appropriate use of the service
  • Maintaining your child's device security

8. Service Availability

We strive to provide reliable service but do not guarantee:

  • Uninterrupted or error-free operation
  • Availability at all times
  • Call quality in all conditions

The App is not intended as a replacement for emergency services. Always ensure alternative means of emergency communication are available.

9. Intellectual Property

The App, including its content, features, and functionality, is owned by Papercup Ltd and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or decompile the App
  • Use our trademarks without permission
  • Remove any proprietary notices

10. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPERCUP LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under New Zealand law, including liability under the Consumer Guarantees Act 1993.

13. Indemnification

You agree to indemnify and hold harmless Papercup Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

14. Termination

We may suspend or terminate your account if you:

  • Breach these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the App. Continued use after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.

17. Dispute Resolution

Before initiating any legal proceeding, you agree to contact us at hello@papercup.kids to attempt to resolve the dispute informally.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Papercup Ltd regarding the App.
